Andes Experience Terms and Conditions

1) Scope of Service

The company organizes and operates sightseeing and adventure tours in the Santiago, Chile region. Itineraries, duration, schedules, and inclusions may vary depending on weather conditions, road conditions, safety, availability of suppliers, parks, resorts, and local authorities.

2) Communication and Schedules

Official tour information (schedule, meeting point, tolerance time, and operational updates) is sent via WhatsApp around 9:00 PM on the day before (Chile time).

  • The valid departure time is the one informed in the message sent the day before.
  • Delays reduce the effective duration of the tour and may result in missing scheduled activities, without the right to a refund.
  • Operational changes (weather, road closures, safety) will be communicated through the same channel as soon as possible.

3) Meeting Point, Delays, and No-Show

  • The meeting point and time are provided in the confirmation sent the day before.
  • Pick-up at your accommodation is only available when the address is within or near the tour route. It is the customer’s responsibility to confirm this condition at the time of booking.
  • Tolerance: up to 10 minutes at the designated meeting point (unless otherwise indicated the day before).
  • No-show: considered a cancellation, and no refund will be provided.

4) Included and Not Included Items

  • Included: transportation and services described in the itinerary or confirmation.
  • Not included: (unless expressly stated): meals, beverages, entrance fees, tastings, clothing/equipment, personal expenses, and travel insurance.
  • On winery tours, entrance fees and tastings may not be included; please confirm the conditions the day before.

4.1 Snow Clothing and Equipment Rental

On snow tours, for logistical reasons, the van may stop at rental shops (“rentals”) for optional clothing or equipment rental. The rental agreement is made directly between the customer and the rental shop, regardless of where it takes place.

Customer Responsibilities:

  • Pick-up, proper use, and timely return;
  • Payment of fees, deposits, and any required charges;
  • Fines for delays, damage, loss, or cleaning;
  • Resolution of any disputes directly with the rental shop.

 

The company does not issue refunds nor adjust itineraries or schedules to accommodate rental shop deadlines.

5) Tour-Specific Rules

5.1 Snowmobile – 2026 Conditions

Format: shared snowmobiles, with 2 participants per vehicle. The price is charged per seat, not per snowmobile.

Activity duration: approximately 2 hours of riding within the National Park, subject to change depending on weather, safety, and operational conditions on the day.

Driving: a valid driver’s license (any category) is required to operate the snowmobile. Passengers without a license are not allowed to drive.

Minimum age: 12 years old. Children under 12 are not permitted on this tour.

Capacity: maximum of 2 occupants per snowmobile. Weight, height, and physical condition limits may vary depending on the model and are assessed on site.

Safety equipment: helmet is mandatory and provided by the operator. The use of gloves and thermal/waterproof clothing is recommended.

Conduct and Safety

The consumption of alcohol or drugs is strictly prohibited before and during the activity.

All participants must strictly follow the instructions of the guides and operational staff.

The company may deny or interrupt participation, without refund, in cases of risky behavior or failure to comply with the rules.

Camera Recording and Liability for Damages

Snowmobiles and/or the guide’s vehicle may be equipped with continuous recording cameras, used for safety, operational control, and incident documentation.

The participant acknowledges and agrees that any damage, accidents, or inappropriate conduct may be assessed based on recorded footage.

The driver is directly responsible for any damage caused to the snowmobile, equipment, infrastructure, third parties, or the environment.

In case of damage, the participant agrees to fully compensate for any losses, including repair, replacement, transport costs, and any downtime of the equipment.

Weather conditions: snow, wind, or low visibility may alter the route, pace, or result in suspension of the activity, always prioritizing safety.

5.1.1 Snowmobile – Adventure Activities with Motorized Vehicles – Liability, Risks, and Damages

By booking and participating in adventure tourism activities operated by Andes Experience / Jeep On Tour, including but not limited to Snowmobile and other motorized vehicle activities in natural environments, the participant expressly declares that:

Acknowledgment of Risks

  • The participant acknowledges that such activities are inherently dangerous, carried out in mountain and natural environments, involving risks such as falls, collisions, rollovers, adverse weather conditions, uneven terrain, mechanical failures, and risks inherent to operating motorized vehicles.
  • The participant declares that participation is voluntary and assumes full responsibility for all risks involved.

Waiver and Limitation of Liability

  • The participant expressly waives, releases, and holds harmless Andes Experience / Jeep On Tour, as well as its partners, directors, managers, guides, staff, service providers, and affiliates, from any claims, actions, or proceedings for physical, material, moral, or financial damages arising from participation, except in cases of proven willful misconduct or gross negligence.
  • The company’s liability is strictly limited to the amount paid for the contracted service.

Financial Responsibility for Damages

  • The participant acknowledges and agrees to be financially responsible for any damage, loss, or harm caused to vehicles, equipment, infrastructure, third parties, or the environment, whether as driver or passenger.
  • This includes, but is not limited to: Repair or replacement costs Transport and logistics of damaged equipment Loss of use and operational downtime

5.2 Colina Hot Springs and Natural Areas

Operations may be suspended due to closures, safety concerns, flooding, landslides, or instructions from authorities. In such cases, force majeure rules apply (item 11).

6) Safety and Conduct

All instructions from staff and local signage must be strictly followed. Failure to comply may result in removal from the activity without refund.

For off-road activities, all participants must sign a liability waiver.

7) Minors

Minors must be accompanied by a legal guardian. Age and height restrictions may apply depending on the activity.

8) Accessibility

Some tours may not be suitable for الأشخاص with reduced mobility or specific medical conditions. Prior consultation is recommended.

9) Changes Requested by the Customer

  • Rescheduling: up to 48 hours in advance, no fee, subject to availability
  • Name change: allowed up to 24 hours before the tour

10) Cancellations and Refunds

By the customer:

  • Up to 5 days (120h): full refund
  • Between 120h and 48h: 70% refund
  • Less than 48h / no-show: no refund

Health-related: with official medical certificate issued in Chile

By the company: rebooking, credit, or full refund.

Refunds are processed within 7 to 15 business days, depending on the payment method.

11) Force Majeure and Mountain Operations

Severe weather, road closures, strikes, accidents, or authority orders may result in changes, postponement, or cancellation of the tour.

12) Third-Party Services and Non-Intermediated Activities

Tours, rentals, optional meals, and any services not expressly included in the itinerary, confirmation, or service annex—and not directly intermediated by Andes Experience / Jeep On Tour—are not the company’s responsibility and are solely the participant’s responsibility.

12.1 Independent Bookings

By choosing to independently book activities at the destination or outside the company’s intermediation, the participant acknowledges full responsibility and releases Andes Experience / Jeep On Tour from any liability related to:

  • Physical, moral, or material damages
  • Accidents, injuries, or death
  • Losses, delays, or cancellations
  • Financial or operational losses

12.2 Travel Insurance and Risk Activities

The participant acknowledges that travel insurance generally does not cover high-risk or adventure activities (such as off-road, motorized tours, hiking, snow, water, height, speed, or extreme environments) unless additional coverage is purchased. By engaging in such activities, the participant accepts that accidents, damages, medical expenses, or rescues may not be covered.

12.3 Full Assumption of Responsibility

The participant declares full awareness of these conditions and assumes total responsibility for their choices, fully releasing Andes Experience / Jeep On Tour from any obligations or liabilities related to non-intermediated services.

13) Adventure Activities with Motorized Vehicles – Risks and Damages

By participating in adventure tourism activities operated by ANDES EXPERIENCE /
JEEP ON TOUR, including but not limited to Snowmobile and other motorized vehicle activities, the participant declares that:

13.1 Risk Acknowledgment

The participant acknowledges that such activities are inherently dangerous, involving risks such as falls, collisions, rollovers, mechanical failures, adverse weather conditions, uneven terrain, and risks inherent to operating motorized vehicles in natural environments.
The participant takes part voluntarily and assumes full responsibility for all risks arising from the activity.

13.2 Liability Waiver

The participant expressly waives, releases, and holds harmless ANDES EXPERIENCE / JEEP ON
TOUR, its partners, directors, managers, guides, staff, and service providers from any claims, actions, or proceedings for personal, material, moral, or financial damages arising from participation in the activities, except in cases of proven willful misconduct or gross negligence.
The company’s liability is, in any case, limited to the amount effectively paid for the contracted service.

13.3 Financial Responsibility

The participant assumes full financial responsibility for any loss, damage, or harm caused to vehicles, equipment, infrastructure, third parties, or the environment, including but not limited to:

  • Repairs or replacement
  • Equipment transport
  • Loss of use

13.4 Camera Recording

The participant acknowledges that the vehicles used in the activities and/or the guides’ vehicles are equipped with continuous recording cameras, used for safety, operational control, and determination of liability.
The recordings may be used as valid evidence in the event of accidents, damages, or inappropriate conduct.

13.5 Rule Violations

Failure to follow rules or unsafe behavior may result in removal without refund and liability for damages.

14) Jurisdiction, Applicable Law, and Final Provisions

To resolve any doubts, disputes, or claims arising from this agreement and its terms and conditions, the parties elect the jurisdiction of the courts of Santiago, Republic of Chile, expressly waiving any other, however privileged it may be.
This agreement is entered into on an irrevocable and irreversible basis, binding the contracting parties, as well as their heirs and successors, to the full compliance with all its clauses and conditions.
By contracting the services, the participant acknowledges having read, understood, and fully accepted these Terms and Conditions.

15) Personal Belongings

The company is not responsible for loss, damage, or theft of personal belongings.

16) Image Use

Photos and videos may be used for promotional purposes. Clients may request not to participate or request removal.

17) Travel Insurance

Highly recommended, especially for adventure activities. Not included unless expressly stated.

  • Contracting the service implies full knowledge and acceptance of these terms.
